A UK asylum seeker who was the driver that fled the scene of a fatal car crash that left a young girl dead has been allowed to remain in Britain.

31-year-old Aso Mohammed Ibrahim of Blackburn was jailed for four months after hitting 12-year-old Amy Houston in 2003. Ibrahim used human rights legislation to invoke the clause that he had a right to a family life in the UK which would be compromised if he was forced to leave after authorities had threatened him with deportation. The legal decision has not found favour with Justice Secretary Jack Straw, also the member for Blackburn, who has claimed that he will be appealing the ruling. The UK Border Agency has also stated that it may seek to appeal the decision.

In 2003, the still alive body of Amy Houston was discovered wedged beneath the wheels of the Rover belonging to Ibrahim in Blackburn’s Newfield Road. Houston died in hospital a short time after.

Ibrahim was found guilty of failing to stop after causing an accident and also of driving whilst being disqualified which lead to his four-month jail term. The UKBA was set to deport the Iraqi father of two but he appealed to the Manchester Asylum and Immigration Tribunal, arguing that Iraq was not a safe place for him and his family to return to.

The UKBA has said it was disappointed with the decision, claiming that it will continue to seek to remove those foreign nationals who represent a danger to the British public.
